Abstract
Pomorsko dobro, kao opće dobro pripada svim ljudima. Ovaj rad razmatra i definira pojam pomorskog dobra u Republici Hrvatskoj kao cjelinu i dijelove pomorskog dobra koji čine luke nautičkog turizma. Kao jedna od vrsta turizma, nautički je turizam turističko-pomorski pojam a iz razloga njegove intenzivne povezanosti s morem i plovidbom njegovo je definiranje složeno jer uključuje turističke komponente te sigurnost plovidbe. U radu se analiziraju temeljni propisi Republike Hrvatske koji sadrže odredbe o lukama nautičkog turizma kao što je Pomorski zakonik i Zakon o pomorskom dobru i morskim lukama. Luke nautičkog turizma u Republici Hrvatskoj razvrstavaju se na sidrišta, odlagališta plovnih objekata, suhe marine i marine. Marine se definiraju kao poslovno turistički objekti smješteni na pomorskom dobru ili izvan njega. Upravo ta činjenica daje im veliku širinu u zakonskom tretmanu jer obuhvaća svu plovidbenu lučku regulativu te samim time u funkcionalnom pogledu sadrži potrebne uvjete za razvoj nautičkog turizama.
Abstract (english)
Maritime good, as a general good belongs to all people. Therefore, this work discusses and defines the concept of maritime domain in the Republic of Croatia as a whole, part of the maritime domain of which nautical tourism ports are a part. As one of the types of tourism, nautical tourism is a tourist-maritime term and due to its intensive connection with the sea and navigation, its definition is complex because it includes tourist components and safety of navigation. This paper analyzes the basic regulations of the Republic of Croatia that contain provisions in nautical tourism ports such as the Maritime Code and the Law on Maritime Property and Seaports. Nautical tourism ports in the Republic of Croatia are classified into anchorages, vessel dumps, dry marinas and marinas. Marinas are defined as business and tourist facilities located on/or outside the maritime domain. It is this fact that gives them great breadth in legal treatment because it encompasses all navigation port regulations and thus in functional terms contains the necessary conditions for development of nautical tourism.
