Abstract
Sudar brodova prema Pomorskom zakoniku nije definiran već prikazan kao fizički kontakt najmanje dva pomorska broda koji za posljedicu ima štetu na njima. U ovom radu institut sudara brodova proveden i analiziran je kroz imovinsko-pravne, procesne i preventivne propise. Spomenute su važnije međunarodne konvencije, zajedno s najnovijim Pravilnikom koji upravlja sigurnošću pomorske plovidbe u Republici Hrvatskoj. Analiziran je pojam sudara zajedno s vrstama istih te uspostavljena veza između naknada šteta i pomorskog osiguranja vezanih za osiguranje odgovornosti. Navedeni su svi troškovi koji općenito nastaju nakon sudara brodova, a na kraju je prikazana uloga zapovjednika te sve njegove dužnosti povezane sa sudarom brodova. S obzirom na istraženo i obuhvaćeno, cilj ovoga rada je pojednostavniti i sažeti svu navedenu problematiku, te približiti i pojasniti sve termine vezane uz temu rada u okviru pomorskopravnih propisa.
Abstract (english)
The ships collision according to the Maritime law is not defined, but is shown as a physical contact of at least two seagoing ships which as a result have damages on them. In this work institute of the collision of ships was carried out and analyzed through property-law, procedural and preventive regulations. Major international conventions have been mentioned, along with the latest regulation which manages the maritime safety in the Republic of Croatia. It was analyzed with the kind of collision identified, the link between claims compensation and liability insurance related to maritime insurance. These are all costs that are generally incurred after the collision of ships, and finally the roles of the commander and all his duties connected with the courts of ships are shown. Given that it has not been explored and covered, the targeted action simplified and summarized all the issues mentioned, and brought closer and clarified all the provisions relating to this issue under maritime law.
