Abstract
Osigurani slučaj je događaj prouzročen osiguranim rizikom i sastoji se od uzroka i posljedice. Osigurana šteta javlja se kao posljedica ostvarenja osiguranog slučaja. Štetne promjene postojećeg stanja mogu biti fizičko uništenje ili pogoršanje stanja osiguranog predmeta i sprječavanje povećanja materijalnog dobra osiguranika, u slučaju osiguranja očekivane dobiti. Za nastanak obveze osiguratelja na isplatu naknade za štetu važni su samo oni uzroci i posljedice koje su osigurane. Postoje tri osnovna ugovora o osiguranju, a to su osiguranje broda, tereta i brodareve odgovornosti. Ugovori su samostalni i međusobno potpuno pravno odvojeni. Sklapanjem ugovora o osiguranju broda i odgovornosti brodar zaštićuje svoj interes, dok sklapanjem ugovora o osiguranju tereta vlasnik tereta prebacuje teret rizika na osiguratelja. Zapovjednik broda ima naglašeno značajnu ulogu u slučaju nezgode koja bi mogla imati za posljedicu gubitak ili oštećenje broda ili tereta, kao i odgovornost prema trećim osobama, neovisno o tome što su tim ugovorima zaštićeni interesi ne samo brodara nego i korisnika prijevoza.
Abstract (english)
The secured case is the event caused by a secured risk. Therefore, secured damage occurs as a result of the secured case. Harmful changes may be physical destruction or deterioration of the insured object's condition. The only causes and the consequences that are ensured are important for the insurer to pay the compensation for damage. There are three basic insurance contracts: ship, cargo and shipowner liability insurance. Contracts are independant and mutually separate from each other. By concluding a contract on vessel insurance and liability, the shipowner protects his interest, while the cargo owner transfers the cargo risk to the insurer by concluding a cargo insurance contract. By Admiralty and Maritime Law, the master of the vessel has crucial role in the event of an accident that could result in the loss or damage of a ship or cargo as well as liability to third parties, irrespective of the fact that these contracts are protected by interests not only of the shipping company but also of the transport user.
