Abstract
U ovom radu obrađuje se državna pripadnost i upis broda. Predmet analize su osnovne imovinsko-pravne karakteristike broda te stjecanje državne pripadnosti i upis broda.Državnom pripadnošću razumijeva se pravna veza između broda i države čiju zastavu brod ovlašteno vije, te obilježava pripadnost nekoj državi koju brod stječe na temelju materijalnih i formalnih pretpostavki. Pomorskim zakonikom Republike Hrvatske propisan je način stjecanja hrvatske državne pripadnosti brodova i drugih plovnih objekata, odnosno način ulaska broda u sastav hrvatske trgovačke mornarice. Hrvatsku državnu pripadnost brod stječe upisom u odgovarajući upisnik brodova ili izdavanjem privremenoga plovidbenog lista.
Abstract (english)
This paper elaborates the national affiliation and registration of the ship. The subject of the analysis is the basic property and legal characteristics of the ship and the acquisition of state affiliation and registration of the ship. National ownership is understood as the legal connection between the ship and the state whose flag the ship is authorized to fly and marks the affiliation to a country that the ship acquires on the basis of material and formal premisses. The Maritime Code of the Republic of Croatia stipulates the way of acquiring Croatian nationality of ships and other vessels, respectively the way of entering the ship into the Croatian merchant fleet. The Croatian nationality is acquired by enrolling in the corresponding ship register or by issuing a temporary navigation document.
