Abstract
Sigurnost u pomorstvu postiže se djelovanjem državnih tijela i međunarodnih organizacija koje donose konvencije, druge propise te provjeravaju njihovo provođenje. U Republici Hrvatskoj su to Ministarstvo nadležno za poslove pomorstva, lučke kapetanije i obalna straža. Pri plovidbi zahtjevnijim područjima kao što su luke, zaljevi, uski i frekventni prolazi, gusto otočje, uski i plitki kanali ili riječni tokovi, poslovi peljarenja su djelatnost koja bitno pridonosi sigurnosti plovidbe. Cilj ovog rada je razrada uloge peljara u pogledu sigurnosti plovidbe te definiranje njegovih zadataka i pravnih pitanja u vezi odgovornosti za štetu uzrokovanu peljarenjem, posebno u vezi ograničenja odgovornosti peljara. Rad, također proučava prednosti i nedostatke svjedodžbe o oslobađanju od obveznog lučkog peljarenja tzv. PEC svjedodžbe (engl. Pilotage Exemption Certificates – PEC).
Abstract (english)
Maritime safety is achieved through the work of state institutions and international organizations who bring up conventions and rules and supervise their implementation. In Repbulic of Croatia, these duties are entrusted to Ministry for maritime affairs, harbour authorities and coast guard. Element that has a great role during the navigation in areas such as harbours, bays, tight sea passages with dense ship traffic, dense islands area, tight and shallow channels or river flows is pilotage. The objective of this article is to elaborate the role of maritime pilot in terms of maritime safety and to define his tasks and his liabilities in cases of damages caused by pilotage, in particular regarding the limited liabilities. Tihs article also studies advantages and disadvantages of PEC – Pilotage Exemption Certificates.
