Abstract
Prijevoznikova temeljna obveza iz ugovora o prijevozu stvari morem je da teret na odredištu preda bez zakašnjenja te u stanju i količini kako ga je i preuzeo na prijevoz. Za izvršenje te obveze, koju je prema naručitelju preuzeo sklapanjem ugovora o prijevozu, prijevoznik odgovara kao nositelj same obveze prijevoza. U slučaju povrede te ugovorne obveze, on će odgovarati drugoj strani za nastalu štetu, koju će morati nadoknaditi. Bitno načelo u pogledu odgovornosti prijevoznika za stvari je ograničenje odgovornosti. Prijevoznik odgovara za teret do prometne, odnosno stvarne vrijednosti, ali ne više od propisane granice, osim u slučaju kvalificirane krivnje prijevoznika kada odgovara neograničeno. U ovom radu ukazuje se na slučajeve kod kojih prijevoznik odgovara za štetu na teretu i zakašnjenje te pobliže objašnjava ugovorno ograničenje odgovornosti prijevoznika za prijevoz stvari morem.
Abstract (english)
Carrier's basic obligation under the contract of carriage of goods by sea is to deliver goods at the destination in the condition and quantity as he took it over for transport and without delay. For fulfillment of that obligation, which he undertook according to the charterer by concluding the contract, the carrier is responsible as the holder of the transport obligation itself. In the event of a breach of this contractual obligation, he will be liable to the other party for damage incurred, which he will have to compensate. An essential principle regarding the liability of the carrier for goods is the limitation of liability. Carrier is liable for goods up to actual value, but not more than the prescribed limit, except in case of qualified fault of the carrier when he will be liable unlimited. This paper points to cases in which the carrier is liable for damage to goods and delay and explains in more detail contractual limitation of carrier's liability for the carriage of goods by sea.
