Abstract
Luke nautičkog turizma jesu luke posebne namjene koje služe za prihvat i smještaj plovila u nautičkom turizmu, opremljene za pružanje usluga korisnicima i plovilima te kao takve čine jedinstvenu cjelinu. Ugovor o vezu je dvostrano obvezan ugovor u kojem pružatelj usluge veza ustupa vez korisniku veza na uporabu za smještaj određene jahte ili brodice i osoba koje na njoj borave, a korisnik veza se obvezuje za to platiti naknadu. Pomorskim zakonikom propisano je kako je ugovor o vezu sklopljen kada su se ugovorne strane suglasile o bitnim elementima ugovora. U svrhu ispunjenja ugovora obje ugovorne strane – pružatelj usluge veza i korisnik usluge veza imaju niz prava i obveza te odgovornosti. Ugovor o vezu sklapa se na određeno vrijeme i prestaje istekom toga vremena, otkazom i propašću veza i/ili propašću jahte ili brodice. U radu se prikazuju sve specifičnosti pravnog uređenja ugovora o vezu kao novog imenovanog ugovora prema Pomorskom zakoniku.
Abstract (english)
Nautical tourism ports are special purpose ports used to accept and accommodate vessels in nautical tourism, equipped to provide services to users and vessels and as such constitute a unique complex. The berth contract is a two-sided obliged contract in which the berth service provider must provide a berth to the user's for the accommodation of a particular yacht or boat and the persons staying there, and the berth user is commited to pay a fee for it. The Maritime Code stipulates that the relationship agreement was concluded when the contracted parties agreed on the essential elements of the contract. For the purpose of fulfilling the contract, both contracted parties – the berth service provider and the berth service user have a number of rights and obligations and responsibilities. The berth contract is concluded for a fixed period of time and terminates by expiriation of that time, the cancellation and failure of the berth and/or the failure of the yacht or boat. This paper presents all the specifics of the legal arrangement of the berth contract as a new named contract under the Maritime Code.
