Abstract
U prošlosti, ali i danas sudari brodova su česta pojava na moru. Pravna regulativa je nužna kako bi se prevenirali sudari ali i odredila naknada štete ukoliko dođe do sudara. Sudari brodova su poseban oblik pomorske štete u kojoj često dolazi do teških materijalnih posljedica za sudionike sudara. Pravna priroda štetnih posljedica sudara brodova pripada redovito partikularnim havarijama. U radu su obrađeni pomorskopravni izvori, međunarodni i nacionalni propisi te odgovornost brodara za štetu na brodovima nastalu kao posljedice sudara. U ovom radu je naglasak stavljen na odgovornost brodara za štete iz sudara te način naknade štete kada se utvrdi njegova odgovornost. Pravni temelj odgovornosti brodara za sudar je dokazana krivnja.
Abstract (english)
In the past, but even today, ship collisions are a common occurrence at sea. Legal regulations are necessary in order to prevent collisions, but also to determine compensation for damage in the event of a collision. Ship collisions are a special form of maritime damage in which severe material consequences often occur for collision participants. The legal nature of the harmful consequences of ship collisions belongs regularly to particular accidents. The paper deals with maritime sources, international and national regulations and shipowners' liability for damage to ships caused by collisions. In this paper, the emphasis is placed on the shipowner's liability for collision damage and the manner of compensation when its liability is determined. The legal basis for a shipowner's liability for a collision is proven guilt.
