Abstract
Spašavanje kao specifični institut pomorskog prava podrazumijeva svaku potrebnu i korisnu uslugu i pomoć pruženu osobama i imovini na moru. Tradicionalno pravo spašavanja, uz obvezno spašavanje ljudskih života, odnosilo se na spašavanje broda, tereta i drugih imovinskih interesa. Danas spašavanje postoji i kao mjera zaštite morskog okoliša. Za uspješno spašavanje imovinskih vrijednosti spašavatelju pripada nagrada za spašavanje, limitirana vijednošću spašenih stvari. To je izraženo engleskim načelom no cure no pay (bez korisnog rezultata nema ni nagrade za spašavanje) koje prihvaća Konvencija o spašavanju, Pomorski zakonik i ugovorni obrazac LOF. Spašavanje imovine često se izvršava temeljem ugovora o spašavanju sklopljenog između spašavatelja i vlasnika stvari u opasnosti. U međunarodnoj plovidbi koristi se engleski tipski ugovorni obrazac Lloyd's Open Form – LOF. Koristi se više od sto godina uz povremene revizije koje prate razvoj suvremenog pomorskog gospodarstva. Danas je u upotrebi LOF 1995 i LOF 2000 (sadrži SCOPIC klauzulu), a najnoviji je iz 2011. – LOF 2011.
Abstract (english)
Salvage as a specific institute of maritime law includes all necessary and useful service and assistance provided to persons and property at sea. Traditional law of salvage, with mandatory rescuing of persons life, also referred to saving ship, cargo and other property interests. Today, salvage exists also as a measure for protecting the marine environment. For the successful rescue of property values, rescuers shall be awarded for the salvage operation, limited with the value of rescued property. That is expressed in English principle of no cure no pay (without useful results there is no award for the salavage) which accepts the Convention on Salvage, Maritime Law and contractual LOF form. Rescuing the property is often operated based on salvage contract, concluded between the salvor and the owner of the property. The international voyage is usually conducted under English standard contractual form LOF – Lloyd's Open Form. It has been in use for more than hundred years with periodic revisions that follow the development of modern maritime economy. Today, in use are LOF 1995 and LOF 2000 (which contains SCOPIC clausule), and the lates one is from 2011. – LOF 2011.
