Abstract
U ovom radu analizirat će se propisi o naknadi štete koja se pojavljuje prilikom sudara brodova. Sudar brodova može se definirat kao pojava gdje jedan ili više brodova izravnim dodirom ili neizravno prouzroči štetu drugom brodu, osobama ili imovini. Za štetu prouzročenu sudarom odgovara brod, odnosno brodovi za koje se dokaže da je njihovom krivnjom šteta prouzročena. Pod odgovornošću broda razumijeva se odgovornost vlasnika broda i brodara. Ako je šteta prouzročena krivnjom dvaju ili više brodova, svaki brod odgovara razmjerno svojoj krivnji. Ako se omjer krivnje, prema prilikama ne može ustanoviti ili ako su krivnje ekvivalentne, odgovornost za štetu dijeli se na jednake dijelove. Na međunarodnom planu naknada štete prilikom sudara brodova regulirana je Međunarodnom konvencijom za izjednačavanje nekih pravila kod sudara brodova, a u Hrvatskoj Pomorskim zakonikom. Oštećenome brodu treba nadoknadom omogućiti uspostavljanje stanja kao prije štete i oštećeni ne smije povećavati štetu kako bi od sudara imao korist.
Abstract (english)
This paper will analyze the compensation for damage that occurs during a ship crash. A ship collision can be defined as an occurrence in which one or more ships directly or indirectly cause damage to another ship or property or to persons on board. The damage caused by the collision shall be the responsibility of the ship or ships which have been proved to be the fault of the damage. Under the responsibility of the ship is understood the responsibility of the shipowne. If damage is caused by the fault of two or more ships, each ship shall be responsible in proportion to its fault. If the fault ratio cannot be ascertained as appropriate or if the fault seems equivalent, liability for damages is split into equal parts. Internationally, the compensation for damages in a ship collision is regulated by the International Convention for the Equalization of Certain Rules in the Collision of Ships, and in Croatia by the Maritime Code. The injured ship should be compensated for the condition as it was before the damage and the injured party must not increase the damage in order to benefit from the collision.
