Abstract
U ovom radu se prikazuje uloga brodarskih ugovora u prijevozu stvari morem te posebno njihovo ispunjenje. Brodarski ugovor je ugovor kojim brodar naručitelju prijevoza na raspolaganje stavlja određeni brod te se obvezuje na prijevoz stvari. Temeljna podjela brodarskih ugovora je na vrijeme ili za jedno ili više putovanja. Zbog velike razvijenosti pomorskog prometa u današnje vrijeme koriste se standardizirani ugovorni obrasci koji uvelike olakšavaju ugovornim stranama sklapanje ugovora i organizaciju prijevoza tereta. Proces prijevoza stvari morem odvija se kroz pet međusobno odvojenih faza, a koje obuhvaćaju sve potrebne radnje od dolaska broda u ukrcajnu luku i ukrcaj tereta, plovidbe, do dolaska broda u iskrcajnu luku i iskrcaja tereta.
Abstract (english)
This paper presents the role of shipping contracts in the transport of goods by sea and especially their fulfillment. A shipping contract is a contract by which the shipping company places a specific ship at the disposal of the transport customer and undertakes to transport goods. The basic division of shipping contracts is on time or for one or more voyages. Due to the great development of maritime transport, standardized contract forms are used nowadays, which greatly facilitate the conclusion of contracts and the organization of cargo transportation. The process of transporting things by sea takes place through five mutually separate phases, which include all the necessary actions from the arrival of the ship to the loading port and the loading of the cargo, navigation, until the arrival of the ship at the unloading port and unloading of the cargo.
