Abstract
Pomorsko osiguranje je pravni posao kojim se jedna stranka uz naplatu odgovarajuće cijene, obvezuje drugoj stranci iz ugovora nadoknaditi štete koje njeni interesi u pomorskom pothvatu pretrpe uslijed ostvarenja ugovorenih opasnosti odnosno rizika. U pomorskom osiguranju postoje neke tipizirane police i klauzule Instituta londonskih osiguratelja - Institute of London Underwriters. Institutske klauzule za osiguranje brodova zbirke su klauzula kojima se reguliraju najvažnija pitanja iz ugovornog odnosa te sklapanjem ugovora o osiguranju broda brodovlasnik zaštićuje svoj vlasničko – pravni interes. Nove klauzule iz 2003. godine poboljšana su verzija nekadašnjih klauzula, omogućuju uspješniji pravni regulativ te pružaju veću sigurnost za obje stranke ugovora o pomorskom osiguranju.
Abstract (english)
Marine insurance is legal act in which one party, along with the payment of the exact price, commits itself to other party which is also named in the agreement that it will pay any damage which their interests may suffer during the marine act in the midlle of agreed hazards or risks. Marine insurance contains certian standarized policies and clauses proposed by the Institute of London Underwritters. Institute clauses for ship insurance are collestions of clausues via which the most important issues from the agreement relations are being regulated and by making ship inurance agreement, the shipowner protect his ownership interest. New clauses from year 2003. are improved version of old clauses, since they enable more successfull legal regulatives and provide more security for both parties included in marine insurance agreement.
