Abstract
Insitutske klauzule za osiguranje robe, poznate pod engleskim nazivom Institute Cargo Clauses, 2009. Izmijenjene su i dopunjene Institute Cargo Clauses iz 1982. Osnovni razlozi za reviziju prijašnjih uvjeta leže u pojavi novih rizika, potrebi da se uvjeti kargo osiguranja prilagode promjenama u suvremenom transportnom sustavu te jezično i terminološki osuvremene. Novi uvjeti donose niz rješenja koja znače modernizaciju u odnosu na rješenja Marine Insurance Acta iz 1906. Redaktori novih uvjeta vodili su računa i o tome da pojedine odredbe budu jasnije formulirane kako bi se izbjegle nejasnoće i dvosmislenosti u njihovu tumačenju. Jedna od najznačajnijih promjena u odnosu na prijašnje stanje je napuštanje koncepta trajanja osiguranja od skladišta do skladišta budući da se on pokazao neprimjerenim suvremenim potrebama. Može se zaključiti da su obavljene izmjene u interesu jedne i druge ugovorne strane. Nove klauzule uspješniji su i suvremeniji pravni regulativ u odnosu na one iz 1982. godine. Zbog toga se može očekivati da će biti prihvaćene u svjetskoj i domaćoj praksi osiguranja.
Abstract (english)
Institute Cargo Clauses, 2009 means the amended Institute Cargo Clauses from 1982. The main reasons for revising the previous conditions lie in the emergence of new risks, the need to adapt cargo insurance conditions to changes in the modern transport system and linguistically and terminologically updated. The new conditions bring a series of solutions that mean modernization in relation to the solutions of the Marine Insurance Act of 1906. The editors of the new conditions also took care that certain provisions were formulated more clearly to avoid ambiguities and ambiguities in their interpretation. One of the most significant changes compared to the previous situation is the abandonment of the concept of insurance duration "from warehouse to warehouse" as it has proven to be inappropriate to modern needs. It can be concluded that the changes were made in the interest of both parties. The new clauses are more successful and more modern legal regulations compared to the I.C.C. of 1982. It can therefore be expected to be accepted in world and domestic insurance practice.
